Cyclone Alfred declared a disaster for DGR purposes
The Income Tax Assessment (Australian Disaster Relief Funds) Amendment Declaration 2025 has been made. It amends the Income Tax Assessment (Australian Disaster Relief Funds) Declaration 2022 so that Tropical Cyclone Alfred is declared as a disaster for the purposes of allowing for deductible gifts or contributions to be made to Australian disaster relief funds supporting those affected by the cyclone. The Declaration commences on 29 March 2025.
No grounds to remit penalties for providing false BAS information
In a matter handed down by the Administrative Review Tribunal of Australia (ARTA) in November 2024, the ARTA upheld administrative penalties imposed on the taxpayer for recklessness on the basis of making a false or misleading statement in relation to input tax credits claimed in his BAS lodgements. The taxpayer had obtained advice from a person who was not a registered tax agent and became registered for GST purposes and multiple BASs were lodged in his name, together with claims being made for input tax credits and GST refunds. The AAT dismissed the taxpayer’s application and found that it was not appropriate to remit the penalty because he provided facts to the ATO in relation to his BAS lodgments that he knew were not correct. ASIC regulatory guide on sustainability reporting
ASIC has published a regulatory guide on sustainability reporting. Regulatory Guide 280 Sustainability reporting (RG 280) provides guidance for entities that are required to prepare a sustainability report containing climate-related financial information under Chapter 2M of the Corporations Act 2001. This may include companies, registered schemes, registrable superannuation entities, and retail corporate collective investment vehicles. ASIC has also issued information on what small businesses need to know about sustainability reporting requirements.
